Medical Malpractice

A medical negligence claim arises when the negligent treatment or omission of medical practitioners, such as doctors or nurses, leads to a person suffering harm as a result thereof.

A medical practitioner is considered to be negligent when the treatment they provide deviates from what is reasonably expected of a medical practitioner in those circumstances and the harm it has caused was preventable.

The outcome of the patients condition must be causally linked to the negligent actions of the medical practitioner.

Road Accident Fund

These are claims for compensation arising from negligent driving of a motor vehicle, for any loss or damage suffered as a result of bodily injuries sustained, or the death of breadwinner.

Personal Injury Claims

Personal injuries sustained in public places claims, or “slip and trips”, are claims for injuries sustained as a result of an accident that occurs on property that is open or accessable to the public, such as shopping centres, bars and restuarants.

Examples of injuries sustained in public places:

  • Injuries caused by slips, trips and falls in supermarkets, shopping centres, bars and cinemas;
  • Injuries caused by dangerous pavements, potholes or tree roots;
  • Injuries caused by steps or staircases in dissrepair;
  • Injuries caused by objects falling from height in public places.

Railway Accidents

It is the responsibility of the Passenger Rail Agency of South Africa (PRASA) to ensure that trains, railway lines, stations and railway crossings are safe and well maintained.

If the agency neglects its duty, and you or a loved one are injured as a result, you may have grounds for a claim.

You may be entitled to claim if:

  • You are personally injured in a railway accident;
  • You are the dependant of a deceased victim of a railway accident;
  • You are pushed on the station platform;
  • You fall or are pushed out of the train;

Professional Indemnity Claims

If an attorney on behalf of a client fails or neglects to claim from another party within the prescribed time period, which is usually 3 years, then the attorney becomes liable to compensate his/her own client for those damages the client should have received if the claim was instituted correctly and timeously.
